3. How to File a DMCA Notice
To report content on the Platform that you believe infringes your copyright, send a written notice to the Designated Agent, or use the in-product "Report Copyright Infringement" option. Under 17 U.S.C. section 512(c)(3), the notice must include:
1. your physical or electronic signature, or that of a person authorized to act for the copyright owner;
2. identification of the copyrighted work claimed to be infringed;
3. identification of the material claimed to be infringing, with enough information for Lesuto to locate it (such as a URL, content ID, or screenshot);
4. your name, address, phone number, and email;
5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
Knowingly misrepresenting that material is infringing may make you liable for damages under 17 U.S.C. section 512(f).
4. How Lesuto Responds to Notices
When Lesuto receives a valid notice, it will: (a) remove or disable access to the material expeditiously, typically within 24 hours of confirming the notice is complete; (b) notify the user who uploaded it and provide a copy of the notice so they can file a counter-notice; and (c) record a strike under the repeat-infringer policy in Section 6.
5. Counter-Notice Process
If your content was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to the Designated Agent that includes: (a) your physical or electronic signature; (b) identification of the removed material and where it appeared before removal; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Lesuto may be found, including the U.S. District Court for the Western District of Texas), and that you will accept service of process from the person who sent the original notice or that person's agent.
When Lesuto receives a valid counter-notice, it forwards a copy to the original complainant. Unless the complainant notifies Lesuto that it has filed a court action seeking to restrain the user, Lesuto restores the material no sooner than 10 and no later than 14 business days after receiving the counter-notice.
6. Repeat Infringer Policy
Under 17 U.S.C. section 512(i)(1)(A), Lesuto terminates the accounts of repeat infringers in appropriate circumstances:
A strike expires 12 months after the content was removed if no further strike is received in that period. A counter-notice that results in restoration removes the related strike.
7. Music and Audio
Do not upload commercial music, such as label-released songs, soundtracks, or recognizable instrumentals, unless you hold a written license that covers that use. Content that includes unlicensed music may be muted, have its audio replaced, or be removed, and a valid notice about it counts as a strike.
8. Reporting In-Product
You can report alleged infringement in Lesuto products using the "Report Copyright Infringement" option on Reels, Stories, posts, livestreams, reviews, and products. In-product reports are routed to the Designated Agent and handled under this policy.
9. Trademark and Other Complaints
For trademark, right-of-publicity, or other non-copyright complaints, contact legal@lesuto.com with the details of your right and the content concerned. We respond within a reasonable time.
